G- Loyalty General Membership Rules

 

  1. These rules (including our Policy on Privacy and Data Protection) govern the collection and use of ‘ GEL Points’ and set out the terms of contract between Green Energy Limited (“us / we”) and each Collector. A Collector can register with the G Points collection program by applying directly at our depots or online and can then earn GEL Points on various purchases and transactions. If you apply to register with GEL to earn GEL Points then you accept these rules. We may refuse an application for any good reason.

  2. We will set up a GEL Account to record GEL Points earned or redeemed by each Collector.

  3. Collectors must be over 18 years and Kenyan residents.

  4. GEL has point of sale where you earn GEL Points. We award GEL Points when a Collector has undertaken an eligible transaction with us. GEL determines the particular transactions on which GEL points can be earned and the number of GEL Points to be earned. Each of these will change but in most cases there will be a base offer (i.e. 1 Point for every 100 KShs spent), with further bonus offers that come and go.

  5. GEL Points cannot be redeemed until credited to a GEL Account.

  6. GEL Points have no expiry date but are lost if the relevant GEL Account is closed or the GEL loyalty Program ends.

  7. Redeemed GEL Points cannot be used again. If a transaction on which GEL Points are issued or redeemed is cancelled, reversed or not completed, we will reverse the associated GEL Points movement when instructed by the relevant Sponsor or Supplier. If insufficient GEL Points are available, or we suspect fraud or misconduct, Rewards may be refused or cancelled.

  8. A Collector who continues to collect will get regular updates (via statement, online account access etc.) of the GEL Points position as we know it on the date we issue the update in respect of his/her GEL loyalty account including the GEL Points collected and redeemed by such Collector on such GEL Account. We will correct an GEL loyalty account if it is shown to our reasonable satisfaction to be wrong but, unless there are clear records showing this, our decision is final.

  9. GEL Points are personal to a GEL loyalty account and cannot normally be transferred. GEL Points can only be transferred from one GEL Account to another GEL Account upon death or divorce if adequate evidence of the legal division of GEL Points is given to us.

  10. GEL Points can only be earned, held, transferred or redeemed as set out in these Rules. Any other use, award, sale, exchange or transfer of GEL Points, or attempt to do so, is a serious breach of these Rules. Any GEL Points not earned and held in accordance with these Rules will be invalid and cannot be redeemed for Rewards. Any such GEL Points on an GEL Account will be deducted and, if they are redeemed, we will cancel the relevant Rewards and we may take appropriate action. GEL Points from more than one GEL Account cannot be combined to redeem for the same Reward. GEL Points have no cash value.

  11. Anyone issued with an ‘GEL’ Card can redeem GEL Points from that account for any available Reward. Security questions may be asked when redemption is made. All Rewards redeemed on an GEL Account which are sent by post will be sent to the latest address we have for the Collector.

  12. GEL Cards are our property and must be returned to us on request or destroyed when no longer valid for use. The Collector is responsible for the security of their Card. If a GEL Card is lost or the holder thinks an unauthorized person has become aware of any security code, password or account number, they should contact the GEL Customer Service Centre immediately. We cannot be responsible for any unauthorized use of GEL Points.

  13. We may close any GEL Account on which no GEL Points have been earned or redeemed for a continuous period of at least 12 months. We may also, upon notifying the Collector, immediately suspend or terminate the rights of such Collector, and/or close any relevant GEL Account, if they breach these Rules, if we reasonably believe that they have dealt with GEL Points in a manner not permitted by these Rules, if there is any theft from or misconduct in connection with us, if they supply false or misleading information to us, if they are abusive or offensive to any member of our staff. A Collector can close his/her GEL Account at any time by notifying us. If a GEL Account is closed any rights to redeem GEL Points from that GEL Account are lost.

  14. We may make changes to these Rules and will give the Collector as much notice as we reasonably can. Earning or redeeming GEL Points on an GEL loyalty account will constitute acceptance of the revised Rules. We may suspend or terminate the GEL loyalty Program but will give as much notice as we reasonably can before we do so. If this happens all GEL loyalty accounts will be suspended or terminated. If we sell or transfer the GEL Program to another company we may transfer all of our rights and obligations under these Rules without any further consent and may disclose or transfer all information we hold about Collectors to a prospective or actual new owner. Such a disclosure or transfer will not alter the rights of such Collectors in respect of the use that can be made of such information by such other company.

  15. Our only responsibilities in respect of the GEL loyalty Program are set out in these Rules which are subject to Kenyan law. We will only be liable to a Collector who suffers loss as a result of our breach of these Rules and, if so, our sole liability will be to credit the relevant GEL loyalty account any GEL Points which have been wrongly deducted or should have been credited but were not. These Rules prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials.

Green Energy Limited is a company registered in Kenya whose registered office is at Green energy Plaza.

 

General Reward Conditions

General - These General Rewards Conditions apply in conjunction with the Collector Rules to any redemption of GEL Points by a Collector for a Reward. The goods, services and discounts advertised are subject to availability and may change from time to time. Always check availability via the GEL Customer Service Centre before making your booking, visit or order.

 

No booking or redemption is accepted until we confirm it to you. GEL Points cannot be redeemed and Vouchers not used in conjunction with any other offer, promotion or discounted rate, unless stated otherwise. The general terms and conditions of the relevant supplier will also apply, so please visit our website, of call the GEL Helpline.

 

GEL Policy on Data Protection and Privacy

This is GEL policy on information collected through the GEL Loyalty Program. It is part of the Collector Rules. Collectors ('you') will provide information on a registration form or other communication with us directly, and when you use your card or give details to earn or redeem GEL Points, the participating company in question will record in its database the details of the transaction on which those GEL Points are earned or redeemed. Any of this information may be used by, and shared between us and participating companies where necessary to operate the GEL Loyalty Program (e.g. so that you can redeem your GEL Points, or to help us prevent abuse of the Program).

 

Information relating to the specific goods or services you buy from us will not be passed to us or any other company or individual. Any information (including your name and address) that does not relate to specific goods or services that you buy (e.g. the number of GEL Points that you earn every month) may be used by us to analyze where and how you use your GEL Card.

 

We may also use that information, to select and communicate offers to you (which may include bonus offers) which we believe are likely to interest you. We may use and analyze that information to market our services to you.
